Terms and Conditions

Last updated: 31 August 2026

These Terms and Conditions ("Terms") govern your use of the hize platform — AI agents for calls, chat, and email automation — available at hize.app (the "Service"). By creating an account or using the Service you agree to these Terms.

1. Service provider

The Service is provided by Arvella sp. z o.o. with its registered office at ul. Sosnowiecka 89, 31-345 Kraków, Poland, entered in the National Court Register (KRS) under number 0001212888, NIP 9452322787, REGON 543556240 ("we", "us"). Contact: hello@hize.app.

2. The Service

hize provides AI-powered communication agents that can answer phone calls, hold chat conversations, process emails, and automate related workflows on your behalf. The exact features available to you depend on your subscription plan.

AI agents generate responses automatically. While we work to make them reliable, AI-generated output may be inaccurate, incomplete, or otherwise flawed, and we do not guarantee its correctness. You are responsible for configuring, instructing, and supervising your agents and for verifying output where accuracy matters.

The Service is not a telephone replacement and does not support emergency calls (e.g. 112, 911). Do not rely on it for contacting emergency services, and do not configure agents to call emergency numbers.

3. Business use only

The Service is intended for businesses and other professional users. By registering you confirm that you are at least 18 years old and are entering into these Terms in the course of a business or professional activity, not as a consumer.

4. Account registration and activation

  • You register by providing your email address and choosing a password.
  • Your account and workspace are created immediately. We may review new accounts before activation; where a review applies, we aim to activate the account within one business day.
  • You will be notified by email when your account has been created and, if activation is not immediate, again when it has been activated.
  • You must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account.
  • We may refuse, suspend, or disable an account that violates these Terms or presents abuse, security, or legal risks.

5. Acceptable use

You agree not to use the Service to:

  • Break any applicable law, or infringe the rights of others
  • Make unsolicited (spam) calls, messages, or emails, or violate telemarketing regulations — for outbound marketing communication you must hold the consents required by law (in Poland, prior consent under telecommunications law; elsewhere, the equivalent local rules such as the TCPA in the US)
  • Impersonate others or misrepresent who is calling, or configure an agent to deny or conceal that it is an AI assistant
  • Call emergency numbers, or emergency lines of healthcare or public-safety services
  • Process special categories of personal data (such as health data) or payment card data through your agents, unless we have agreed to this with you in writing
  • Attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service

6. AI disclosure

hize agents identify themselves as AI assistants, and the platform provides disclosure mechanisms (such as an announcement at the start of a call). Where the law — including Article 50 of the EU AI Act — requires informing people that they are interacting with an AI system, you must keep such disclosure enabled and must not configure your agents to circumvent it.

7. Calls, recordings, and your data

  • Depending on your configuration, the Service processes call audio, transcripts, chat messages, and email content in order to operate your agents.
  • You are the controller of the data your agents process; we process it on your behalf as described in the Privacy Policy and in section 13 below.
  • You are responsible for obtaining any consents required from your callers and contacts (e.g. for call recording) in your jurisdiction. The platform provides disclosure mechanisms (such as a recording announcement) to help you meet these obligations.

8. Data storage and export

The Service is a communication platform, not a storage, backup, or archival service. Recordings, transcripts, messages, and files are stored for your convenience, subject to the retention settings of your workspace and the limits of your plan; content beyond those limits may be deleted. You can export your data at any time and are responsible for keeping your own copies of anything you need to retain — including where retention is required of you by law.

9. Fees and billing

  • Pricing is described on the pricing page. Plans include a monthly fee and usage allowances; usage beyond the allowance is billed at the published overage rates.
  • Fees are charged in advance for subscription periods and are non-refundable except where required by law.
  • We may change prices with at least 30 days' notice; changes apply from the next billing period after the notice period ends.

10. Availability and support

We aim for high availability but the Service is provided "as is" and "as available". Planned maintenance and factors outside our control (including telephony carriers and third-party providers) may affect availability.

11. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or related to the Service is limited to the fees you paid for the Service in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, for the content of conversations conducted by AI agents configured by you, or for the consequences of relying on AI-generated output. Nothing in these Terms limits liability that cannot be limited under applicable law (including liability for willful misconduct).

12. Indemnification

You will indemnify us against claims by third parties arising from your use of the Service in breach of these Terms — in particular claims relating to unlawful marketing communication, missing recording or AI-disclosure consents, or the content and instructions you provide to your agents.

13. Data processing on your behalf

For personal data that your agents process on your behalf (section 7), the following data-processing terms form part of these Terms and constitute the data-processing agreement between you (controller) and us (processor) under Article 28 GDPR:

  • Subject matter, nature, and purpose: processing of communication content (call audio and recordings, transcripts, chat messages, emails, and related contact data) to operate your agents; duration: the term of our agreement; data subjects: your callers, customers, and contacts.
  • We process this data only on your documented instructions, expressed through your use and configuration of the Service, unless the law requires otherwise.
  • Persons authorized to process the data are bound by confidentiality. We apply the technical and organizational measures described in the Privacy Policy.
  • We assist you, insofar as reasonably possible, with responding to data-subject requests and with your obligations under Articles 32–36 GDPR, and we notify you without undue delay after becoming aware of a personal data breach affecting your data.
  • You give general authorization for the sub-processors we use to operate the Service (the categories are listed in the Privacy Policy). We will inform you of intended changes, and you may object on justified grounds; transfers outside the EEA take place only with the safeguards described in the Privacy Policy.
  • Upon termination we delete or return the data as described in section 8 and the Privacy Policy, unless the law requires further storage. We make available the information necessary to demonstrate compliance with this section and allow for audits as required by Article 28(3)(h) GDPR.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts for material breach of these Terms. Upon termination your data remains available for export for 30 days, after which it is deleted in line with the Privacy Policy.

15. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-product notice before they take effect. Continued use of the Service after the effective date constitutes acceptance.

16. Governing law, language, and contact

These Terms are governed by the laws of Poland. Any disputes will be resolved by the competent courts in Poland, unless mandatory law provides otherwise.

These Terms are available in Polish and English; in case of discrepancies, the Polish version prevails.
